제1장 총칙
제1조 적용 범위
These Terms of 서비스 ("Terms") govern the use of the reservation assistance, communication support, interpretation support, and related services ("서비스") provided by [서비스 Name] ("Company"). 이용자 shall use the 서비스 in accordance with these Terms. The English version of these Terms shall be the official and governing version. Any translated version is provided for reference purposes only.
제2조 정의
For purposes of these Terms:
- "User" means a person using the 서비스 directly or through an authorized proxy.
- "Patient" means the individual receiving medical services.
- "의료기관" means clinics, hospitals, pharmacies, and other healthcare-related providers in Japan.
- "Reservation Completion" means the point at which the 의료기관 confirms the reservation and the Company sends a confirmation notice to the User.
- "Authorization Hold" means a temporary payment authorization prior to Reservation Completion.
- "Interpretation Provider" means a third-party interpreter or translator arranged by the Company.
제3조 서비스 내용
The 서비스 assists 이용자 in obtaining reservations at 의료기관s in Japan, primarily for elective and private medical services. The 서비스 may include reservation assistance, communication support, AI-assisted translation, interpretation support, and related services. [서비스 Name] does not recommend, rank, endorse, or guarantee any 의료기관.
제4조 의료행위 부인
[서비스 Name] does not provide diagnosis, treatment, prescriptions, medical judgment, medical advice, or emergency medical services. All medical decisions shall be made solely by the User and licensed medical professionals.
제5조 서비스 이용 환경
이용자 are responsible for preparing and maintaining all devices, communication lines, software, and internet access necessary to use the 서비스. [서비스 Name] shall not be liable for issues caused by communication failures, device settings, or third-party services.
제2장 등록 및 계정
제6조 등록
이용자 shall provide truthful, accurate, and current information when registering.
제7조 이메일 인증
[서비스 Name] may require email verification before use of the 서비스. 이용자 shall maintain a valid email address capable of receiving Company notices.
제8조 대리 예약
Family members, companions, or third parties authorized by the Patient may make reservations on behalf of the Patient. The proxy making the reservation represents and warrants that valid authorization has been obtained.
제9조 계정 정보 관리
이용자 shall promptly update any changed registration information. [서비스 Name] shall not be responsible for disadvantages caused by inaccurate or outdated information.
제10조 계정 관리
이용자 shall properly manage their accounts and may not share, transfer, lend, or allow third parties to use them.
제3장 예약 서비스
제11조 예약 신청
Reservation requests must be submitted through the designated reservation form. Medical history, symptoms, medications, and related information may be voluntarily submitted through forms or chat.
제12조 예약 지원
[서비스 Name] will contact 의료기관s based on information provided by the User. [서비스 Name] does not guarantee reservation availability, preferred dates, treatment availability, or acceptance by any 의료기관.
제13조 예약 완료
Reservations are completed only upon:
- confirmation by the 의료기관; and
- transmission of a reservation confirmation notice by the Company.
제14조 예약 실패 및 중단
Reservations may fail due to 의료기관 availability, medical restrictions, language limitations, regional limitations, or insufficient information. If reservations cannot be completed, the Company shall release or void the Authorization Hold.
제15조 의료기관과의 관계
Any medical contract shall be formed directly between the User or Patient and the 의료기관. [서비스 Name] is not a party to medical treatment or medical services.
제16조 의료기관 정보
[서비스 Name] does not guarantee the accuracy, completeness, legality, usefulness, or current status of 의료기관 information.
제17조 예약 변경 및 취소
Changes or cancellations after Reservation Completion shall follow 의료기관 policies and Company procedures. Fees paid to the Company are generally non-refundable after Reservation Completion.
제4장 번역 및 통역 서비스
제18조 AI 번역
The 서비스 may utilize AI-assisted translation technologies. AI-generated translations may contain errors, inaccuracies, omissions, or contextual misunderstandings.
제19조 통역 서비스
[서비스 Name] may arrange third-party interpretation providers for voice-call interpretation support. Interpretation services are limited to language assistance and do not constitute medical advice or medical practice.
제20조 통역 서비스의 제한
Interpretation services do not guarantee complete or perfectly accurate translation of medical explanations. 이용자 shall directly confirm important medical matters with 의료기관s.
제21조 녹음 및 기록
[서비스 Name] may record or retain calls, chats, communications, and logs for quality improvement, dispute resolution, fraud prevention, compliance, and interpretation quality management.
제22조 응급 의료 상황
The 서비스 does not provide emergency medical support. 이용자 should immediately contact emergency services, including 119 in Japan, during emergencies.
제5장 요금 및 결제
제23조 요금
이용자 shall pay reservation assistance fees, interpretation option fees, and other fees separately displayed by the Company. Medical expenses, prescriptions, examination fees, and pharmacy charges shall be paid directly to 의료기관s or pharmacies.
제24조 승인 보류
[서비스 Name] may perform an Authorization Hold through third-party payment providers before Reservation Completion.
제25조 결제 확정
Payment capture shall occur only after Reservation Completion. If reservations cannot be completed, the Company shall release or void the Authorization Hold.
제26조 환불 불가 정책
After Reservation Completion and payment capture, fees are non-refundable except where required by law or where the Company determines that a material defect in the 서비스 occurred.
제27조 결제 서비스 제공업체
Payments are processed through Stripe or other third-party payment providers designated by the Company. [서비스 Name] does not directly store credit card numbers except where legally required.
제28조 환율 및 수수료
Foreign exchange fluctuations, overseas payment fees, and banking charges may cause differences between displayed and charged amounts.
제6장 이용자 의무 및 금지행위
제29조 정확한 정보 제공 의무
이용자 shall provide accurate, complete, and current information. [서비스 Name] shall not be liable for disadvantages caused by inaccurate or incomplete information.
제30조 금지 행위
이용자 shall not:
- provide false information;
- impersonate others;
- harass staff, interpreters, 의료기관s, or third parties;
- use the 서비스 for unlawful purposes;
- reproduce or redistribute 서비스 content without authorization;
- use bots, scraping, or automated tools;
- resell the 서비스;
- create multiple accounts; or
- interfere with operation of the 서비스.
제31조 지적재산권
All intellectual property rights relating to the 서비스 belong to the Company or lawful rights holders.
제32조 서비스 방해 금지
이용자 shall not interfere with the systems, networks, servers, security, or operations of the 서비스.
제7장 정지 및 종료
제33조 서비스 정지
[서비스 Name] may suspend access to the 서비스 without prior notice if the User violates these Terms.
제34조 계정 삭제
[서비스 Name] may delete accounts and deny future access for serious violations. Refunds may be denied in such cases.
제35조 서비스 변경 또는 종료
[서비스 Name] may modify, suspend, or terminate the 서비스 at any time.
제8장 개인정보 및 데이터 처리
제36조 개인정보 처리
[서비스 Name] may collect names, dates of birth, gender, nationality, email addresses, accommodation information, symptoms, medical history, medications, and related information necessary for operation of the 서비스.
제37조 의료 관련 정보
이용자 consent to the use of medical-related information for reservation assistance, 의료기관 communication, and interpretation support.
제38조 제3자 제공 및 위탁
[서비스 Name] may share or entrust User information to 의료기관s, interpretation providers, payment providers, cloud service providers, AI providers, and other contractors.
제39조 AI 서비스 이용
[서비스 Name] may utilize external AI services including OpenAI API for translation, communication support, and quality improvement.
제40조 로그 및 기록 보관
[서비스 Name] may retain logs, reservation records, communication records, and payment records for compliance, fraud prevention, dispute resolution, and quality management.
제9장 면책 및 책임 제한
제41조 예약 관련 면책
[서비스 Name] does not guarantee reservation success, preferred dates, treatment availability, or 의료기관 availability.
제42조 의료 관련 면책
[서비스 Name] shall not be liable for medical outcomes, side effects, prescriptions, treatment results, or disputes involving 의료기관s.
제43조 번역 및 통역 면책
[서비스 Name] does not guarantee error-free translations or interpretation.
제44조 통신 장애
[서비스 Name] shall not be liable for failures caused by communication issues, system failures, third-party service failures, or device problems.
제45조 불가항력
[서비스 Name] shall not be liable for delays or failures caused by natural disasters, epidemics, war, legal changes, government actions, or other force majeure events.
제46조 책임 제한
To the maximum extent permitted by law, the Company's liability shall be limited to refunds of fees actually paid for the affected 서비스. [서비스 Name] shall not be liable for indirect, incidental, consequential, special, lost-profit, or medical-related damages.
제10장 일반 조항
제47조 약관 변경
[서비스 Name] may amend these Terms at any time. Amended Terms become effective upon publication on the 서비스 unless otherwise specified.
제48조 통지
[서비스 Name] may provide notices through the 서비스, email, chat, or other methods designated by the Company.
제49조 양도 금지
이용자 may not assign or transfer rights or obligations under these Terms without prior written consent from the Company.
제50조 분리 가능성
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain fully effective.
제51조 준거법
These Terms shall be governed by and construed in accordance with the laws of Japan.
제52조 관할
Any disputes arising out of or relating to these Terms or the 서비스 shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court in Japan.
