Bab 1 Ketentuan Umum

Article 1 Applicability

These Terms of Layanan ("Terms") govern the use of the reservation assistance, communication support, interpretation support, and related services ("Layanan") provided by [Layanan Name] ("Company"). Article 2 Definitions

  4. "Reservation Completion" means the point at which the Institusi Medis confirms the reservation and the Company sends a confirmation notice to the User.
  5. "Authorization Hold" means a temporary payment authorization prior to Reservation Completion.
  6. "Interpretation Provider" means a third-party interpreter or translator arranged by the Company.

Article 3 Description of the Service

The Layanan assists Pengguna in obtaining reservations at Institusi Mediss in Japan, primarily for elective and private medical services. The Layanan may include reservation assistance, communication support, AI-assisted translation, interpretation support, and related services. [Layanan Name] does not recommend, rank, endorse, or guarantee any Institusi Medis.

Article 4 No Medical Practice

[Layanan Name] does not provide diagnosis, treatment, prescriptions, medical judgment, medical advice, or emergency medical services. All medical decisions shall be made solely by the User and licensed medical professionals.

Article 5 Service Environment

Pengguna are responsible for preparing and maintaining all devices, communication lines, software, and internet access necessary to use the Layanan. [Layanan Name] shall not be liable for issues caused by communication failures, device settings, or third-party services.

Bab 2 Pendaftaran dan Akun

Article 6 Registration

Article 7 Email Verification

Article 9 Account Information Management

Pengguna shall promptly update any changed registration information. [Layanan Name] shall not be responsible for disadvantages caused by inaccurate or outdated information.

Article 10 Account Management

Pengguna shall properly manage their accounts and may not share, transfer, lend, or allow third parties to use them.

Bab 3 Layanan Reservasi

Article 11 Reservation Requests

Reservation requests must be submitted through the designated reservation form. Medical history, symptoms, medications, and related information may be voluntarily submitted through forms or chat.

Article 12 Reservation Assistance

[Layanan Name] will contact Institusi Mediss based on information provided by the User. [Layanan Name] does not guarantee reservation availability, preferred dates, treatment availability, or acceptance by any Institusi Medis.

Article 13 Reservation Completion

Reservations are completed only upon:

  1. confirmation by the Institusi Medis; and
  2. transmission of a reservation confirmation notice by the Company.

Article 14 Reservation Failure and Suspension

Reservations may fail due to Institusi Medis availability, medical restrictions, language limitations, regional limitations, or insufficient information. If reservations cannot be completed, the Company shall release or void the Authorization Hold.

Article 15 Relationship with Medical Institutions

Any medical contract shall be formed directly between the User or Patient and the Institusi Medis. [Layanan Name] is not a party to medical treatment or medical services.

Article 16 Medical Institution Information

[Layanan Name] does not guarantee the accuracy, completeness, legality, usefulness, or current status of Institusi Medis information.

Article 17 Reservation Changes and Cancellations

Changes or cancellations after Reservation Completion shall follow Institusi Medis policies and Company procedures. Fees paid to the Company are generally non-refundable after Reservation Completion.

Bab 4 Layanan Terjemahan dan Interpretasi

Article 18 AI Translation

The Layanan may utilize AI-assisted translation technologies. AI-generated translations may contain errors, inaccuracies, omissions, or contextual misunderstandings.

Article 19 Interpretation Services

[Layanan Name] may arrange third-party interpretation providers for voice-call interpretation support. Interpretation services are limited to language assistance and do not constitute medical advice or medical practice.

Article 20 Limitations of Interpretation Services

Interpretation services do not guarantee complete or perfectly accurate translation of medical explanations. Pengguna shall directly confirm important medical matters with Institusi Mediss.

Article 21 Recording and Logs

[Layanan Name] may record or retain calls, chats, communications, and logs for quality improvement, dispute resolution, fraud prevention, compliance, and interpretation quality management.

Article 22 Emergency Medical Situations

The Layanan does not provide emergency medical support. Pengguna should immediately contact emergency services, including 119 in Japan, during emergencies.

Bab 5 Biaya dan Pembayaran

Article 23 Fees

Pengguna shall pay reservation assistance fees, interpretation option fees, and other fees separately displayed by the Company. Medical expenses, prescriptions, examination fees, and pharmacy charges shall be paid directly to Institusi Mediss or pharmacies.

Article 24 Authorization Hold

[Layanan Name] may perform an Authorization Hold through third-party payment providers before Reservation Completion.

Article 25 Payment Capture

Payment capture shall occur only after Reservation Completion. If reservations cannot be completed, the Company shall release or void the Authorization Hold.

Article 26 Non-Refund Policy

After Reservation Completion and payment capture, fees are non-refundable except where required by law or where the Company determines that a material defect in the Layanan occurred.

Article 27 Payment Providers

Payments are processed through Stripe or other third-party payment providers designated by the Company. [Layanan Name] does not directly store credit card numbers except where legally required.

Article 28 Exchange Rates and Fees

Foreign exchange fluctuations, overseas payment fees, and banking charges may cause differences between displayed and charged amounts.

Bab 6 Kewajiban Pengguna dan Tindakan yang Dilarang

Article 29 Obligation to Provide Accurate Information

  3. harass staff, interpreters, Institusi Mediss, or third parties;
  4. use the Layanan for unlawful purposes;
  5. reproduce or redistribute Layanan content without authorization;
  6. use bots, scraping, or automated tools;
  7. resell the Layanan;
  8. create multiple accounts; or
  9. interfere with operation of the Layanan.

Article 31 Intellectual Property Rights

All intellectual property rights relating to the Layanan belong to the Company or lawful rights holders.

Article 32 Prohibition of Service Interference

Bab 7 Penangguhan dan Penghentian

Article 33 Suspension

Article 38 Third-Party Sharing and Outsourcing

Article 39 Use of AI Services

Article 40 Retention of Logs and Records

Bab 9 Penafian dan Batasan Tanggung Jawab

Article 41 Reservation Disclaimer

[Layanan Name] does not guarantee reservation success, preferred dates, treatment availability, or Institusi Medis availability.

Article 42 Medical Disclaimer

Article 43 Translation and Interpretation Disclaimer

Article 44 Communication Failures

Article 46 Limitation of Liability

Any disputes arising out of or relating to these Terms or the Layanan shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court in Japan.
