Terms of Service

Chapter 1 General Provisions

Article 1 Applicability

These Terms of Service ("Terms") govern the use of the reservation assistance, communication support, interpretation support, and related services ("Service") provided by [Service Name] ("Company"). Users shall use the Service in accordance with these Terms. The English version of these Terms shall be the official and governing version. Any translated version is provided for reference purposes only.

Article 2 Definitions

For purposes of these Terms:

  1. "User" means a person using the Service directly or through an authorized proxy.
  2. "Patient" means the individual receiving medical services.
  3. "Medical Institution" means clinics, hospitals, pharmacies, and other healthcare-related providers in Japan.
  4. "Reservation Completion" means the point at which the Medical Institution confirms the reservation and the Company sends a confirmation notice to the User.
  5. "Authorization Hold" means a temporary payment authorization prior to Reservation Completion.
  6. "Interpretation Provider" means a third-party interpreter or translator arranged by the Company.

Article 3 Description of the Service

The Service assists Users in obtaining reservations at Medical Institutions in Japan, primarily for elective and private medical services. The Service may include reservation assistance, communication support, AI-assisted translation, interpretation support, and related services. The Company does not recommend, rank, endorse, or guarantee any Medical Institution.

Article 4 No Medical Practice

The Company does not provide diagnosis, treatment, prescriptions, medical judgment, medical advice, or emergency medical services. All medical decisions shall be made solely by the User and licensed medical professionals.

Article 5 Service Environment

Users are responsible for preparing and maintaining all devices, communication lines, software, and internet access necessary to use the Service. The Company shall not be liable for issues caused by communication failures, device settings, or third-party services.

Chapter 2 Registration and Accounts

Article 6 Registration

Users shall provide truthful, accurate, and current information when registering.

Article 7 Email Verification

The Company may require email verification before use of the Service. Users shall maintain a valid email address capable of receiving Company notices.

Article 8 Proxy Reservations

Family members, companions, or third parties authorized by the Patient may make reservations on behalf of the Patient. The proxy making the reservation represents and warrants that valid authorization has been obtained.

Article 9 Account Information Management

Users shall promptly update any changed registration information. The Company shall not be responsible for disadvantages caused by inaccurate or outdated information.

Article 10 Account Management

Users shall properly manage their accounts and may not share, transfer, lend, or allow third parties to use them.

Chapter 3 Reservation Services

Article 11 Reservation Requests

Reservation requests must be submitted through the designated reservation form. Medical history, symptoms, medications, and related information may be voluntarily submitted through forms or chat.

Article 12 Reservation Assistance

The Company will contact Medical Institutions based on information provided by the User. The Company does not guarantee reservation availability, preferred dates, treatment availability, or acceptance by any Medical Institution.

Article 13 Reservation Completion

Reservations are completed only upon:

  1. confirmation by the Medical Institution; and
  2. transmission of a reservation confirmation notice by the Company.

Article 14 Reservation Failure and Suspension

Reservations may fail due to Medical Institution availability, medical restrictions, language limitations, regional limitations, or insufficient information. If reservations cannot be completed, the Company shall release or void the Authorization Hold.

Article 15 Relationship with Medical Institutions

Any medical contract shall be formed directly between the User or Patient and the Medical Institution. The Company is not a party to medical treatment or medical services.

Article 16 Medical Institution Information

The Company does not guarantee the accuracy, completeness, legality, usefulness, or current status of Medical Institution information.

Article 17 Reservation Changes and Cancellations

Changes or cancellations after Reservation Completion shall follow Medical Institution policies and Company procedures. Fees paid to the Company are generally non-refundable after Reservation Completion.

Chapter 4 Translation and Interpretation Services

Article 18 AI Translation

The Service may utilize AI-assisted translation technologies. AI-generated translations may contain errors, inaccuracies, omissions, or contextual misunderstandings.

Article 19 Interpretation Services

The Company may arrange third-party interpretation providers for voice-call interpretation support. Interpretation services are limited to language assistance and do not constitute medical advice or medical practice.

Article 20 Limitations of Interpretation Services

Interpretation services do not guarantee complete or perfectly accurate translation of medical explanations. Users shall directly confirm important medical matters with Medical Institutions.

Article 21 Recording and Logs

The Company may record or retain calls, chats, communications, and logs for quality improvement, dispute resolution, fraud prevention, compliance, and interpretation quality management.

Article 22 Emergency Medical Situations

The Service does not provide emergency medical support. Users should immediately contact emergency services, including 119 in Japan, during emergencies.

Chapter 5 Fees and Payments

Article 23 Fees

Users shall pay reservation assistance fees, interpretation option fees, and other fees separately displayed by the Company. Medical expenses, prescriptions, examination fees, and pharmacy charges shall be paid directly to Medical Institutions or pharmacies.

Article 24 Authorization Hold

The Company may perform an Authorization Hold through third-party payment providers before Reservation Completion.

Article 25 Payment Capture

Payment capture shall occur only after Reservation Completion. If reservations cannot be completed, the Company shall release or void the Authorization Hold.

Article 26 Non-Refund Policy

After Reservation Completion and payment capture, fees are non-refundable except where required by law or where the Company determines that a material defect in the Service occurred.

Article 27 Payment Providers

Payments are processed through Stripe or other third-party payment providers designated by the Company. The Company does not directly store credit card numbers except where legally required.

Article 28 Exchange Rates and Fees

Foreign exchange fluctuations, overseas payment fees, and banking charges may cause differences between displayed and charged amounts.

Chapter 6 User Obligations and Prohibited Conduct

Article 29 Obligation to Provide Accurate Information

Users shall provide accurate, complete, and current information. The Company shall not be liable for disadvantages caused by inaccurate or incomplete information.

Article 30 Prohibited Conduct

Users shall not:

  1. provide false information;
  2. impersonate others;
  3. harass staff, interpreters, Medical Institutions, or third parties;
  4. use the Service for unlawful purposes;
  5. reproduce or redistribute Service content without authorization;
  6. use bots, scraping, or automated tools;
  7. resell the Service;
  8. create multiple accounts; or
  9. interfere with operation of the Service.

Article 31 Intellectual Property Rights

All intellectual property rights relating to the Service belong to the Company or lawful rights holders.

Article 32 Prohibition of Service Interference

Users shall not interfere with the systems, networks, servers, security, or operations of the Service.

Chapter 7 Suspension and Termination

Article 33 Suspension

The Company may suspend access to the Service without prior notice if the User violates these Terms.

Article 34 Account Deletion

The Company may delete accounts and deny future access for serious violations. Refunds may be denied in such cases.

Article 35 Modification or Termination of the Service

The Company may modify, suspend, or terminate the Service at any time.

Chapter 8 Privacy and Data Handling

Article 36 Handling of Personal Information

The Company may collect names, dates of birth, gender, nationality, email addresses, accommodation information, symptoms, medical history, medications, and related information necessary for operation of the Service.

Article 37 Medical-Related Information

Users consent to the use of medical-related information for reservation assistance, Medical Institution communication, and interpretation support.

Article 38 Third-Party Sharing and Outsourcing

The Company may share or entrust User information to Medical Institutions, interpretation providers, payment providers, cloud service providers, AI providers, and other contractors.

Article 39 Use of AI Services

The Company may utilize external AI services including OpenAI API for translation, communication support, and quality improvement.

Article 40 Retention of Logs and Records

The Company may retain logs, reservation records, communication records, and payment records for compliance, fraud prevention, dispute resolution, and quality management.

Chapter 9 Disclaimer and Limitation of Liability

Article 41 Reservation Disclaimer

The Company does not guarantee reservation success, preferred dates, treatment availability, or Medical Institution availability.

Article 42 Medical Disclaimer

The Company shall not be liable for medical outcomes, side effects, prescriptions, treatment results, or disputes involving Medical Institutions.

Article 43 Translation and Interpretation Disclaimer

The Company does not guarantee error-free translations or interpretation.

Article 44 Communication Failures

The Company shall not be liable for failures caused by communication issues, system failures, third-party service failures, or device problems.

Article 45 Force Majeure

The Company shall not be liable for delays or failures caused by natural disasters, epidemics, war, legal changes, government actions, or other force majeure events.

Article 46 Limitation of Liability

To the maximum extent permitted by law, the Company's liability shall be limited to refunds of fees actually paid for the affected Service. The Company shall not be liable for indirect, incidental, consequential, special, lost-profit, or medical-related damages.

Chapter 10 General Provisions

Article 47 Amendments to these Terms

The Company may amend these Terms at any time. Amended Terms become effective upon publication on the Service unless otherwise specified.

Article 48 Notices

The Company may provide notices through the Service, email, chat, or other methods designated by the Company.

Article 49 Prohibition of Assignment

Users may not assign or transfer rights or obligations under these Terms without prior written consent from the Company.

Article 50 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain fully effective.

Article 51 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan.

Article 52 Jurisdiction

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court in Japan.
